Is it legal for me to release information to you about a former employee including information in their personnel file? 

Yes.  Every bit of information we gather is done under the authority granted by the applicant when they sign the Authorization for Release of Information and this is in compliance with both state and federal law. We will provide you with a permanent copy of this Authorization before asking for any information.  For more information on the state and federal statute on this subject

I thought it was illegal to ask an applicant about their arrest record.  Is there a legal way to do this?

Yes, under strict guidelines.  The Equal Employment Opportunity Commission has stated, conduct, not the arrest or conviction per se, which the employer may consider in relation to the position sought.” In the same opinion the commission stated conviction information is generally assumed to be factual because of the required weight of proof to obtain a conviction but arrests that do not result in a conviction cannot, on their face, be believed accurate.  Arrests that do not result in a conviction should be researched and supporting documentation obtained before they are considered in the hiring process. 

There are several other additional requirements and recommendations from the EEOC about how to request and use arrest and conviction information in the hiring process.

How do you charge for your services? 

Fees vary depending on the specific service(s) used and the responsibility assigned to the position being filled.  A local arrest or conviction check can be done for as little as $25.00.  A background check to help fill a CEO position for a large corporation would be more involved and more costly.  These types of checks routinely require field interviews and investigations and are performed for an hourly rate.

Do I have to sign a contract for services? 

There is a basic contract required that will spell out the responsibility of all parties.  All fees are based on services rendered.  There is no start up fee when the contract is signed and the contract can be terminative by either party at any time. 

How is information gathered on applicants?

Background Consulting Services, Inc. uses an Authorization for Release form that is signed by the applicant that gives us the authority to gather needed information and to share that information with the employer.

I am in charge of recruiting volunteers for my not-for-profit organization.  Can you help us do background checks on volunteers without placing us in a financial hardship?

Background Consulting Services, Inc understands the special demands placed on not-for-profits with limited resources.  We encourage not-for-profit organizations to contact us because we do have special services available.
